Esta gu\u00eda explica, en un lenguaje sencillo, c\u00f3mo funciona la detenci\u00f3n, qui\u00e9nes pueden optar a una audiencia de fianza, qu\u00e9 sucede en el tribunal y c\u00f3mo un abogado de inmigraci\u00f3n con experiencia puede protegerle.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">\u00bfQu\u00e9 es la detenci\u00f3n de inmigrantes?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">La detenci\u00f3n migratoria es un delito civil, no penal. Las personas permanecen detenidas mientras el gobierno decide si pueden quedarse en Estados Unidos o deben ser deportadas. Una vez que firme, puede ser muy dif\u00edcil \u2014a veces imposible\u2014 retractarse.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">\u00bfQui\u00e9nes re\u00fanen los requisitos para una audiencia de fianza de inmigraci\u00f3n?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">La detenci\u00f3n de inmigrantes se rige principalmente por la Ley de Inmigraci\u00f3n y Nacionalidad (INA). En t\u00e9rminos sencillos, existen dos grupos principales:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Personas que el juez puede considerar para la libertad bajo fianza (detenci\u00f3n discrecional).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Personas sujetas a detenci\u00f3n obligatoria, que normalmente no pueden obtener la libertad bajo fianza.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Usted podr\u00eda calificar para una audiencia de fianza si:<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Usted no es una persona que haya llegado recientemente a la frontera y se encuentre bajo un proceso de expulsi\u00f3n acelerada.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Usted no se encuentra en una categor\u00eda de detenci\u00f3n obligatoria (por ejemplo, ciertas condenas penales graves o m\u00faltiples, preocupaciones de seguridad nacional o algunas situaciones previas de expulsi\u00f3n\/reingreso).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ICE le ha entregado una Notificaci\u00f3n para Comparecer y lo ha sometido a un proceso de expulsi\u00f3n (deportaci\u00f3n).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Debido a que estas normas son complejas y cambian con frecuencia, nunca d\u00e9 por sentado que no cumple con los requisitos. Un abogado de inmigraci\u00f3n con experiencia puede revisar su historial y determinar si es posible una audiencia de fianza en su caso.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">C\u00f3mo solicitar una audiencia de fianza<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Una audiencia de fianza es una audiencia judicial separada donde un juez de inmigraci\u00f3n decide:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Si puede ser liberado de la custodia de ICE y<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">En ese caso, \u00bfcu\u00e1nto fianza debe pagar usted (o un patrocinador)?.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Por lo general, puede solicitar una audiencia de fianza de la siguiente manera:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Presentar una solicitud por escrito directamente al tribunal de inmigraci\u00f3n donde se asign\u00f3 su caso; o<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hacerle esta pregunta al juez de forma oral en su primera audiencia del Calendario General.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Puntos importantes:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Las audiencias de fianza son independientes de su caso principal de deportaci\u00f3n.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Puede solicitar una revisi\u00f3n de la fianza m\u00e1s de una vez si su situaci\u00f3n cambia (por ejemplo, nuevas pruebas, un cambio en la custodia penal o nuevas opciones de alivio).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Si el ICE ya ha fijado una fianza, puede solicitar al juez que la reduzca (una &quot;reconsideraci\u00f3n&quot; de la fianza).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Dado que el tiempo es crucial, especialmente si su ser querido est\u00e1 sufriendo en prisi\u00f3n, conviene solicitar la audiencia de fianza lo antes posible.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">\u00bfQu\u00e9 sucede en una audiencia de fianza de inmigraci\u00f3n?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">En la audiencia de fianza, el juez de inmigraci\u00f3n se centrar\u00e1 en dos preguntas principales:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00bfRepresentas un peligro para la comunidad?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00bfEs probable que comparezca en todas sus futuras audiencias judiciales si queda en libertad?<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">El juez examina muchos factores, entre ellos:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">V\u00ednculos familiares en los EE. Puede hacerlo presentando lo siguiente:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cartas de familiares, empleadores, l\u00edderes religiosos, maestros o miembros de la comunidad.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Comprobante de domicilio y comprobante de que vivir\u00e1 con un patrocinador responsable.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Evidencia de tratamiento o rehabilitaci\u00f3n por problemas pasados (por ejemplo, terapia o rehabilitaci\u00f3n).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Documentos que demuestren s\u00f3lidos argumentos para obtener protecci\u00f3n, como una petici\u00f3n familiar pendiente o pruebas de asilo.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">El juez puede:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Otorgar bonos y fijar una cantidad<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se deniega la fianza (permanece detenido).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Continuar (aplazar) la audiencia para revisar m\u00e1s pruebas.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">La ley establece una fianza m\u00ednima de 1500, pero el juez puede ordenar una cantidad mucho mayor seg\u00fan el caso. Usted o su ser querido generalmente pueden apelar una denegaci\u00f3n o una fianza muy elevada, pero las apelaciones son largas y complejas.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">\u00bfC\u00f3mo se paga una fianza de inmigraci\u00f3n?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Si el juez concede la libertad bajo fianza:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cualquier ciudadano estadounidense o residente permanente legal puede depositar la fianza como \u201cdeudor\u201d.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">El deudor suele pagar la fianza en una oficina de ICE mediante cheque bancario o fondos certificados.
